Collision ClaimsPosted by confused_homeowner_579

4 months and a state DOI complaint later, Geico finally paid my collision claim - here is the timeline and what actually moved them

finally closed out my Geico collision claim last week so writing this up while its fresh. if anyone is staring down a low ball offer or appraisal stalling, here is what worked for me month by month.

setup: t-boned at an intersection in february, other driver ran the red and was at fault. his Progressive liability paid the medical side reasonably fast. i carried collision on my 2022 Subaru Outback so we went through my own Geico policy for the vehicle damage (faster than waiting on the other carrier and Geico subrogates against Progressive later).

initial Geico estimate: $8,200. Subaru certified body shop estimate: $14,800. the $6,600 gap came from four things - Geico used aftermarket parts not OEM, refused to pay for blind spot sensor recalibration ($1,400 from the dealer), assumed labor at $30/hr below shop standard for my zip code, and skipped some clip retainers and one panel they claimed could be straightened (could not). shop refused to start work at Geicos number. standoff.

Month 1: requested supplemental, sent the body shops itemized counter line by line. Geico assigned a field re-inspector who came out, confirmed damage was real, then went back to the same low number. added $400 and called it final.

Month 2: filed an appraisal demand under my policy. most auto policies have an appraisal clause but you have to invoke it formally in writing - read your declarations and policy form. once invoked, both sides name an appraiser, they pick an umpire, and the umpire breaks any tie. Geico stalled 23 days on naming their appraiser. i named mine in 4 days ($350 flat fee, body shop recommended someone they had worked with before).

Month 3: appraiser was named but Geico would not agree to an umpire. filed a complaint with California DOI citing CCR 2695.7(b) on unfair claims practice (delay tactics in invoked appraisal). attached my full correspondence log dated and timestamped. 6 business days later i got a call from Geico, a "claims manager" now on the line with my original adjuster. revised offer: $13,200. shop still would not start.

Month 4: proceeded to appraisal. umpire ruled at $14,650. Geico paid within the 30 days policy requires. shop started repairs the next week.

out of pocket for me: $350 appraiser fee plus $200 rental car overage when Geicos rental coverage ran out during the dispute. would have been $6,400 out of pocket if i had taken their first offer. the thing that actually moved them was not arguing harder, it was creating procedural pressure. appraisal demand forced them out of unilateral decision making. DOI complaint forced executive review of the file. once my claim was no longer a routine adjuster decision, the cost benefit math shifted on their side and the number moved. happy to share the DOI complaint template if anyone wants it.
