Balance billing from out of network ER doctor - is this legal?

Went to an in-network hospital ER. Got treated by a doctor who apparently was out of network even though I had no choice in who treated me. Now I have a $3,400 balance bill from the doctor's practice.

I thought the No Surprises Act was supposed to prevent this? Am I wrong? This feels illegal.
