NYC apartment water damage - whos responsible?

Upstairs neighbors pipe burst and flooded my apartment. Building says its not their problem, my renters insurance says claim against the neighbor, neighbors insurance says they need to investigate.

Its been 6 weeks and nothing is fixed. Does New York have any specific laws about this? Im out of my apartment, paying rent still, and nobody will cover temporary housing.
