LTD claim denied after 2 years - insurer says I'm not disabled anymore. I absolutely still am.
I was approved for long-term disability benefits through my employer's group plan two years ago after a workplace injury left me with serious back and nerve damage. The policy pays 60% of my salary. Last month I got a letter saying my benefits are terminated because their independent medical examination found I'm "capable of sedentary work." The IME doctor spent 45 minutes with me, barely touched me, and his report contradicts everything my treating physicians have documented for two years. My own specialists have consistently said I can't sit for more than 20 minutes without significant pain, can't stand for extended periods, and am not capable of working any job reliably.
I'm now completely cut off financially. I have a mortgage and two kids. I don't know where to start. I know I can appeal internally but I've heard the insurer almost always upholds their own denials. Is it worth hiring a disability attorney? Is there anything I can do to strengthen an appeal if the IME report is the main thing they're citing?
