Uninsured MotoristPosted by worriedbuyer6

rear-ended at a red light by an uninsured driver 6 weeks ago and my own carrier (Geico) is dragging its feet on my UM claim. what does the actual path forward look like?

looking for people who have actually been through this because im starting to feel like im being slow-walked on purpose. setup: sitting at a red light on the way home from work in early may, full stop for at least 15 seconds, get rear-ended by a guy doing maybe 25-30. i go forward into the car in front of me lightly. police show up, he has no insurance, expired registration, and a license that turns out to be suspended. he gets cited for all of it plus the no-insurance, and we exchange info with the third driver. car looks ok from outside but my neck and lower back are toast within 48 hours.

i carry Geico with UM/UIM at $100k/$300k. open a UM claim the next morning. adjuster #1 is fine, takes my recorded statement, says "submit your bills and we will evaluate." 4 weeks of PT later (going 3x/week, decent improvement on the neck, lower back is still angry), MRI shows a small disc bulge at L5-S1 and another at C5-C6 that the radiologist says is "likely traumatic." total medical to date is about $11,400. lost wages from missing 4 days plus reduced hours another $2,800.

now im on adjuster #3. each handoff has reset the timeline and the new person asks for documents the previous person already had. last week #3 asked for "all prior medical records for the past 5 years" which my attorney friend says is fishing and im not obligated to hand over unrelated history. i pushed back politely and she went silent for 9 days. yesterday she finally responded and said they need to "complete the investigation" before they can discuss settlement.

my questions for anyone whos been here:

1) is the 5-year medical records ask normal or is it a delay tactic? what do people actually provide vs decline?

2) at what point does a UM claim become "bad faith" vs just slow? we are at 6 weeks with active medical treatment, two MRI findings, and zero settlement discussion.

3) is there a number at which it stops being worth handling solo? a buddy keeps saying "any soft tissue with imaging needs an attorney" but i dont want to give up a third of the settlement if i dont have to.

any war stories or playbooks appreciated. i pay this premium specifically so i dont have to fight my own company and yet here we are.
