Roof ClaimsPosted by angry_member_55

Allstate is offering to replace only the storm-damaged slope of my roof but the shingles have been discontinued - is there a "matching law" argument here and how do i make it stick?

looking for anyone who has fought a partial-roof replacement before. background: april hailstorm in north dallas, golf ball sized hail, our neighborhood got hammered. our roof is 11 years old, architectural shingles, original to the house. roofer came out, inspector came out, everyone agrees the south slope is totaled. north slope has 4 impacts that the carrier called "cosmetic," east and west slopes show some granule loss but no functional damage per their report.

here is where it gets weird. allstate authorized full replacement of the south slope only. $9,400. our roofer pulled the shingle code (GAF Timberline Natural Shadow, "Weathered Wood" colorway) and confirmed it was discontinued in 2019. closest current match is a "Pewter Gray" which is visibly different in person, our roofer brought samples to the house. allstate's position is that they "owe like kind and quality" but "like kind and quality does not require a perfect color match" and pointed us to a paragraph in the policy.

i talked to a public adjuster who mentioned that texas has a regulation about uniform appearance for roof claims but he was vague on the citation and said it varies by carrier. our roofer says half the houses he reroofs in our area end up with the homeowner paying out of pocket to make slopes match because carriers refuse. our HOA actually has a covenant about consistent roof appearance which adds another wrinkle.

questions for the room: (1) is there an actual statute or department of insurance bulletin in texas i can cite? (2) has anyone successfully appealed a partial-roof denial to a full replacement based on matching? (3) is this the kind of thing where it makes sense to invoke the appraisal clause? our deductible is 2% of dwelling so were not looking at a windfall here, were looking at not having a roof that looks like a quilt.
