Diminished ValuePosted by policyHolderMike

Got $3,800 diminished value check from at-fault driver insurer in Georgia - heres what worked

Wanted to share this because I almost gave up on the diminished value claim and im glad i didnt. Last March a guy ran a red light and t-boned my 2022 Honda Accord. His Geico policy covered the repairs ($8,200) and rental no problem. The car looked perfect after the body shop finished but i knew the carfax would show the accident forever.

I asked the Geico adjuster about diminished value and she basically said "we dont automatically pay that, you'd have to prove the loss." Translation: figure it out yourself or go away. I almost dropped it but then i remembered Georgia is one of the better states for DV claims (3rd party).

Here's what i did. Paid $375 for an independent appraisal from a DV appraiser (not the dealer, those guesses arent worth anything). The report came back showing $4,100 in diminished value. I sent it certified mail with a demand letter referencing Georgia's 17C formula and Mabry v State Farm. Geico countered at $2,400, i countered at $3,950, we settled at $3,800 about 6 weeks later.

Not legal advice but if you have a newer car and it was the other driver's fault, dont leave this money on the table. The appraisal is the whole game.
